​Terms and Conditions for Non CSA Produce Sales


  • You (the customer) are responsible for inspecting all produce at the time of pick-up.
  • We (the seller) shall be responsible for damaged produce for decay and physical damage.
  • We (the seller) will not warranty produce for color or shape as naturally grown produce comes in unpredictable shapes and colors.​
  • No returns will be accepted if we (the seller) are not contacted with-in six (6) hours of the time you picked up your produce to report an issue with your items.
  • All orders must be placed no later than 6 hours before the pick-up time.
  • ALWAYS practice the habit of WASHING your fresh fruits and vegetables, no matter where they come from (farmers’ market, grocery, CSA, your back yard, etc.) 

​Terms, Conditions and Guidelines of the 2020 CSA Program(s)


  1. Addendum's and or changes may at any time be made by Penick Farms to the following as need to insure the CSA program operates in a fair and reasonable manner.
  2. Members are considered to have read and agreed to the follow when or before a member signs-up for any Penick Farms CSA program.

Section I   
  1. Purchasing of Penick Farms CSA share(s) in no way implies ownership ether in full or in part of Penick Farms and/or any property or assets of Penick Farms or its owner(s).
  2. Penick Farms CSA program is a “farm managed” program.
  3. Members understand and accept the inherent risks involved in Community Supported Agriculture programs.
  4. Members understand that each week’s produce will and may vary due to but not limited to seasonal availability, weather conditions, insect damage and other acts beyond the control of the farm.
  5. Given that produce comes in many different densities and sizes, and the total of produce harvested every week may vary greatly. Penick Farms does not guarantee any specific amount of any specific item for any specific distribution cycle.
  6. Although we will make attempts to communicate with members via e-mail and/or by phone. Members are responsible for checking our Facebook ( https://www.facebook.com/penick.farms/ ) page for official updates to the CSA program.
  7. All deposits and payments on CSA shares and CSA share add on's are non-refundable.
  8. If a member is unable to take or pickup their weekly share they may in advance designate someone else to receive their share by contacting Penick Farms by e-mail 24 hours in advance. Unclaimed shares will be donated to a charity at the discretion of Penick Farms.
  9. We will gladly accept responsibility for damage and/or decay WHEN we are contacted within 12 hours of delivery and/or pickup. After 12 hours, there are too many other possible contributing factors that come into play for us to be held responsible.
  10. The practice of “sharing” or “splitting” of baskets or Membership shares is not recommended by Penick Farms. Shares are distributed with the principle that it is consumed by a single house hold preparing meals together. Penick Farms will make no attempt to stop members from splitting or sharing distribution but strongly discourages the practice. Further to that degree, Penick Farms will not be responsible for any disputes or clams of any kind arising from sharing or splitting of distribution.
